Section 45 of the Trademark Act, 15 U.S.C. Section 1127, defines "trademark" to include any word, name, symbol, or device, or any combination thereof--

1. used by a person, or
2. which a person has a bona fide intention to use in commerce and applies to register on the principal register established by this Act, to identify and distinguish his or her goods, including a unique product, from those manufactured or sold by others and to indicate the source of the goods, even if that source is unknown.

Protecting and using your trademark or servicemark can maintain one of the business' potentially valuable assets. When you have decided to protect your trademark, contact Mr. Cooke and work with him to determine that you have a distinctive mark.

Next have Mr. Cooke prepare a comprehensive clearance search and provide a legal opinion on whether the mark is available for use and registration. After a positive evaluation, Mr. Cooke can work with you to prepare the application for registration.

Before registration, a business can designate its trademark by using "TM." Do not use the "®" symbol before the Patent and Trademark Office issues a Certificate of Registration.
